Derecho y blockchain: ¿compatibles?

Abstract

RESUMEN: En la actualidad, el Derecho afronta nuevos retos nunca planteados previamente. La incorporación de numerosas tecnologías ha revolucionado por completo métodos, procesos y sistemas que, hasta ahora, no se habían cuestionado. Las incontables ventajas que incorporan estas nuevas tecnologías suponen a su vez ciertos retos ciertos retos que el Derecho debe superar para adaptarse a la sociedad altamente digitalizada y exigente de procesos más rápidos seguros fiables y transparentes. En este trabajo se intentará sintetizar las grandes ventajas que supondría la incorporación de la tecnología blockchain y de los Smart Contracts al mundo del derecho y como progresivamente esto que puede parecer una idea se está convirtiendo en una realidad.

ABSTRACT: Nowadays, law is facing new challenges that have never been faced before. The incorporation of numerous technologies has completely revolutionised methods, processes and systems that, until now, had not been questioned. The numerous advantages of these new technologies in turn pose certain challenges that law must overcome in order to adapt to a highly digitalised society that demands faster, more reliable, secure and transparent processes. This paper will attempt to synthesise the great advantages that the incorporation of blockchain technology and Smart Contracts into the world of law would bring and how this, which may seem like an idea, is gradually becoming a reality.
