Propiedad intelectual en España: evolución histórica y justificación

Abstract

RESUMEN: Este TFG aborda el encaje de la propiedad privada en el derecho español en lo relativo a su justificación, tanto ética como utilitarista, dentro de nuestro sistema. En primer lugar, se define el concepto de propiedad intelectual para aclarar y centrar cuál va a ser el objeto del análisis, ya que es una idea compleja con múltiples enfoques. Después, examinaremos la evolución histórica de la propiedad intelectual y cómo ha sido tratada por los diferentes ordenamientos jurídicos en los que ha existido. Finalmente, se abordará la cuestión de la justificación de la propiedad intelectual y la necesidad de incluirla en nuestro sistema legal, para lo cual se examinarán sus fundamentos éticos y utilitaristas y se comparará con la propiedad sobre bienes tangibles.

ABSTRACT: This TFG addresses the fit of the intellectual property in spainish law with reference to its justification, both the ethical and utilitarian, in our system. First of all, we will define the intellectual property concept to clarify and focus on which is going to be the object of analysis, since it is a complex idea whith multiple approaches. After that, we will examine the historical evolution of intellectual property and how it has been addressed by the many legal systems it had been existed. Finally, we will approach the issue of intellectual property justification and the need to include it in our legal system, for which we will examine its ethical and utilitarian reasons and compare it to the property over tangible assets.
