La libertad de testar en el ordenamiento jurídico español

Abstract

RESUMEN: El presente trabajo de fin de grado (en adelante TFG) tiene como finalidad dar a conocer la distinta libertad de testar existente en España, tanto en los territorios que se rigen por el Derecho Civil Común, como los que cuentan con un Derecho Foral propio. Explicaré cuáles son los límites que existen, en caso de que los haya. En concreto, analizaré la figura de la legítima y quiénes son los herederos forzosos que tienen derecho a la misma, además de hablar de su aceptación en la sociedad actual y las inclinaciones en las últimas reformas legislativas.

ABSTRACT: The purpose of this end-of-degree project (hereinafter TFG) is to make known the different freedom to make a will that exists in Spain, both in the territories that are governed by Common Civil Law, and those that have their own Foral Law. I will explain what the limits are, if any. Specially, I will analyze the figure of the legitime and who are the forced heirs who are entitled to it, in addition to talking about its acceptance in today´s society and the inclinations in the latest legislative reforms
