Inteligencia artificial, big data y derecho sanitario: reflexiones a la luz de los Derechos Fundamentales

Abstract

RESUMEN: Vivimos inmersos y rodeados de tecnología inteligente en muchos aspectos de nuestras vidas y uno de ellos es el ámbito sanitario. Ante dicho escenario, este trabajo persigue analizar los retos del empleo del big data y la inteligencia artificial dentro del sector médico. Para poder aprovechar esta herramienta es necesaria la intervención del Derecho sanitario como disciplina encargada de salvaguardar su buen uso y, sobre todo, su incidencia en los derechos fundamentales, los cuales se deben garantizar en todo caso. A través de una reflexión crítica se propone apoyar en la creación de un marco jurídico sólido en materia de big data empleada en el sector sanitario, teniendo presente lo relevante y beneficioso que es esta tecnología para el mundo.

ABSTRACT: We live immersed and surrounded by smart technology in many aspects of our lives, and one of them is the healthcare sector. In light of this scenario, this paper aims to analyse the challenges of the use of big data and artificial intelligence in the medical sector. In order to take advantage of this tool, the intervention of health law is necessary as the discipline in charge of safeguarding its proper use and, above all, its impact on fundamental rights, which must be guaranteed in any case. Through a critical reflection, it is proposed to support the creation of a solid legal framework in terms of big data used in the health sector keeping in mind how relevant and beneficial this technology is for the world.
