La diligencia de entrada y registro en domicilio

Abstract

RESUMEN: La finalidad perseguida con este trabajo, no es otra que presentar al lector una somera aproximación de lo que supone la diligencia de entrada y registro en domicilio. Para ello, pondremos especial atención en algunos puntos clave como pueden ser, el art. 18.2 que defiende la inviolabilidad del domicilio, así como algunos artículos posteriores al 545 de la LECrim, que regulan parte de la diligencia mentada. Por otra parte, es importante resaltar que la exposición, dará comienzo con la aclaración del concepto de domicilio, además de lo que se puede considerar como tal y lo que no, en vista de la posible aplicación de la diligencia en determinados lugares. Como culmen del trabajo, iremos repasando, los puntos esenciales para la aplicación de la diligencia, conjuntamente con sus requisitos, es decir, situaciones que lo habilitan, momento y lugar de la práctica, e inclusive, los intervinientes. Todo ello perfectamente coordinado para conformar la legitimidad de la diligencia, aunque también comentaremos parcialmente lo que sucede cuando la diligencia no está correctamente practicada y cuales son sus principales consecuencias.

ABSTRACT: The aim of this work is none other than to present the reader with a brief approximation of what is involved in the diligence of entry and search of homes. To do so, we will pay special attention to some key points such as art. 18.2, which defends the inviolability of the home, as well as some articles subsequent to 545 of the LECrim, which regulate part of the aforementioned procedure. On the other hand, it is important to highlight that the exposition will begin with the clarification of the concept of domicile, as well as what can and cannot be considered as such, in view of the possible application of the diligence in certain places. At first glance, it may seem that the definition of the concept of domicile is perfectly well known to all and easy to understand, but in the eyes of the law it is not, due to the fact that over the years case law has collected a multitude of possible definitions that have been modified and adapted according to each specific moment and situation. As the culmination of the work, we will go over the essential points for the application of diligence, together with its requirements, that is to say, the situations that enable it, the time and place of the practice, and even the intervening parties. All of this is perfectly coordinated in order to conform the legitimacy of the diligence. Although we will also partially comment on what happens when the diligence is not correctly carried out.
