Incidencia de la pandemia COVID-19 en el trabajo marítimo estudio y análisis.

Abstract

RESUMEN: El presente trabajo tiene como objetivo proporcionar un análisis sobre los efectos de los múltiples cambios normativos en el marco del trabajo marítimo, todo ello derivado de la pandemia ocasionada por el virus COVID-19, tanto en el ámbito internacional, como en España, con el fin de determinar si estos cambios fueron suficientes para mantener un equilibrio entre la protección de las cadenas de suministros, la salud y las condiciones laborales de los Marinos Mercantes. Para ello, se hace una investigación de tipo documental, enfocada en documentos de fuentes primarias relativos al COVID 19 compartidos por la OMI, así como las órdenes y decretos emitidos por las instituciones que integran el Gobierno de España. Con el fin de dar contexto sobre las decisiones tomadas en el plano nacional, se incluye una comunicación y una guía emitidas por la Unión Europea que se consideraron pertinentes. Los análisis se hacen por separado en función de su origen, sin embargo, entre los objetivos se plantea igualmente determinar la sinergia existente entre ellos. Además, se evalúa el efecto en elementos claves de esta actividad, como los cambios introducidos en los contratos de fletamento o la flexibilización de obtención de permisos y certificados.

ABSTRACT: The objective of this project is to provide an analysis of the effects of the multiple regulatory changes in the framework of maritime work, all derived from the pandemic caused by the COVID-19 virus, both internationally and in Spain, with to determine if these changes were sufficient to maintain a balance between the protection of supply chains, health and working conditions of Merchant Seafarers. To do this, a documentary-type investigation is carried out, focused on primary source documents related to COVID 19 shared by the IMO, as well as the orders and decrees issued by the institutions that make up the Government of Spain. In order to give context to the decisions taken at the national level, a communication and a guide issued by the European Union that were considered pertinent are included. The analyzes are carried out separately depending on their origin, however, among the objectives it is also proposed to determine the synergy between them. In addition, the effect on key elements of this activity is evaluated, such as the changes introduced in charter contracts or the flexibility of obtaining permits and certificates.
