RESUMEN. La Constitución Española reconoce el
derecho de los padres a que sus hijos reciban
la educación religiosa de acuerdo
con sus creencias. La Ley Orgánica de
Libertad Religiosa incluye el derecho a
la enseñanza religiosa como parte integral
del derecho a la libertad religiosa.
Sin embargo la LOGSE limita la enseñanza
religiosa en las escuelas a las Confesiones
que han firmado Convenios de
Cooperación con el Estado (Iglesia Católica,
Protestantes, Judíos y la Federación
Musulmana). El nombramiento de los
profesores, el contenido de las materias
y los manuales son responsabilidad de
las Confesiones Religiosas. El Estado
paga el sueldo de los profesores cuando,
al menos, tienen 10 alumnos. Los alumnos
que no escogen religión han de seguir
una materia alternativa.
ABSTRACT. The Spanish Constitution recognizes
parents’ right to have their children
receive a religious education according to
thier beliefs. The Religious Freedom Act
(LOLR) includes the right to religious
teaching as an integral part of the right
to religious freedom. Nevertheless, the
Educational System Act (LOGSE) limits
religious teaching in school only to
Confessions that have signed Cooperation
Agreements with the State according
with their terms (Catholic Church, and
the Protestant, Jew and Muslim
Federations). The designations of the
teachers, the subject’s content and the
manuals are responsibility of the
Confessions. The State covers the
professor’ salaries when there are at least
ten students per teacher. Students that
do not choose this subject have to follow
an alternate course.
