Le Labyrintho de comercio terrestre y naval de Juan de Hevia Bolaño et le droit maritime

Abstract

RÉSUMÉ. Le Livre III du Labyrintho de comercio terrestre y naval d'Hevia Bolaño est une expression de l'histoire juridique transnationale du droit maritime de la monarchie hispanique. L'auteur refond le droit maritime créé par les marins sur les côtes européennes depuis le Moyen Âge, avec celui institué par la monarchie pour réglementer le commerce avec les Indes sous un régime de monopole. La compréhension de l'ouvrage requiert de le lier au processus « d'établissement du droit » effectué par la monarchie et à la situation de la doctrine du droit commercial et maritime au début du XVIe siècle.

ABSTRACT. The III Book of the Labyrintho de comercio terrestre y naval by Hevia Bolaño is an expression of the transnational legal history of maritime law of the Hispanic Monarchy. The author recasts the maritime law created by sailors on the European coasts since the Middle Ages, with the maritime law established by the Monarchy to order trade with the Indies under a monopoly regime. Understanding it requires linking the book with the « process of establishing the law » made by the Monarchy and with the situation of the doctrine on mercantile and maritime law in the early sixteenth century.
