Derecho a la propia imagen, redes sociales y la sentencia del Tribunal Constitucional 27/2020

Abstract

RESUMEN: Hoy en día utilizamos con más frecuencia las redes sociales, incorporando su uso a nuestras vida casi como una rutina. Este hecho ha incidido en el derecho y ha incrementado los conflictos jurídicos relacionados con el mundo de Internet. Dentro del derecho, un ámbito que se ha visto enormemente afectado es el de los derechos recogidos en el artículo 18.1 de la Constitución Española ya que en los últimos tiempos se ha producido un aumento significativo de las intromisiones ilegitimas a estos derechos. Este trabajo busca plasmar esa problemática, centrándose en el derecho a la propia imagen, y analizar qué soluciones están tomando actualmente los Tribunales. Concretamente se va a hacer hincapié en la Sentencia 27/2020, de 24 de febrero de 2020 dictada por el Tribunal Constitucional cuyo interés reside en la fundamentación que hace sobre el derecho a la propia imagen en el ámbito digital y su relación con los medios de comunicación y las redes sociales.

ABSTRACT: Nowadays we use social networks more often, incorporating them into our day to day life and routines. This has had an effect in Right and has increased the number of legal conflicts related to the usage of the Internet. Within the wider concept of Right, there has been an evolution on how the Right to personality and self-identity is understood as can be seen in Article 18.1 of the Spanish Constitution. In the last few years there’s been a significant increase in the illegitimate interferences to those Rights. This study aims to portray this topic, focusing on the Right to self-image and analyzing what measures are currently being taken by the Courts. Specific emphasis will be placed on Sentence 27/2020, of the 24th February 2020 issued by the Spanish Constitutional Court. The main focus of this sentence will be the justification that the image itself makes on the right in the digital realm, as well as media and social networks.
