La figura del matrimonio y sus tendencias actuales

Abstract

RESUMEN: El matrimonio es una de las figuras más antiguas reconocidas por los antiguos ordenamientos jurídicos, pero al igual que la sociedad, ha ido evolucionando y modificándose. Los cónyuges adquieren beneficios, pero también obligaciones y es por ello por lo que los matrimonios deben protegerse, tanto para evitar fraudes como los conocidos matrimonios de conveniencia, como para proteger a los contrayentes y terceras personas que pudieran verse implicadas sobretodo en situaciones de crisis matrimonial. Como veremos, se ha posibilitado el matrimonio para relaciones distintas de la tradicional unión heterosexual, así como se ha producido un alejamiento de los matrimonios celebrados por la Iglesia y de los matrimonios en sí en virtud de otros tipos de unión menos formales como pueden ser las parejas de hecho.

ABSTRACT: Marriage is one of the oldest figures recognized by the old legal systems, but like society, it has been evolving and changing. The spouses acquire benefits, but also obligations and that is why marriages must be protected, both to avoid fraud such as the well-known marriages of convenience, as well as to protect the contracting parties and third parties who could be involved especially in situations of marital crisis. As we will see, marriage has been made possible for relationships other than the traditional heterosexual union, as well as a departure from marriages celebrated by the Church and from marriages themselves by virtue of other less formal types of union such as common-law couples.
