La mediación como instrumento de resolución alternativa de conflictos

Abstract

RESUMEN: A lo largo de la historia, el conflicto siempre ha estado presente en nuestras vidas, considerándose desde la prehistoria como algo negativo que había que evitar. Hoy en día, el conflicto es inevitable en las relaciones sociales, sin embargo, el transcurso del conflicto puede ser constructivo o destructivo. Actualmente, uno de los mecanismos alternativos a la resolución del conflicto reside en el procedimiento de mediación. En el siguiente trabajo, he querido realizar una visión general del conflicto como antecedente al procedimiento de mediación. Para ello, desglosaremos en primer lugar, el concepto, los tipos y la gestión del conflicto. En segundo lugar, el trabajo versa sobre el procedimiento de mediación, por ende, estudiaremos como la evolución social y la influencia comunitaria ha llevado al legislador a regular este procedimiento. Nos enfocaremos en analizar las fases, los modelos y los principios rectores de la mediación. Para darle un enfoque práctico, he desarrollado a lo largo del trabajo diferentes técnicas de gestión de las emociones como habilidades y técnicas del mediador en un procedimiento de mediación.

ABSTRACT: Throughout history, conflict has always been present in our lives, since prehistoric times have been considered as something negative that had to be avoided. Today, conflict is inevitable in social relationships, however, the course of conflict can be constructive or destructive. Currently, one of the alternative mechanisms to the resolution of the conflict resides in the mediation procedure. In the following work, I have wanted to make an overview of the conflict as a precedent to the mediation procedure. To do this, we will first break down the concept, types and management of the conflict. Secondly, the work deals with the mediation procedure, therefore, we will study how social evolution and community influence have led the legislator to regulate this procedure. We will focus on analyzing the phases, models and guiding principles of mediation. To give it a practical approach, I have developed throughout the work different techniques for managing emotions as skills and techniques of the mediator in a mediation procedure.
