Venta a distancia de medicamentos: origen y marco normativo actual en España

Abstract

RESUMEN: La venta de medicamentos a distancia ha supuesto una revolución en el sector farmacéutico tanto a nivel nacional como a nivel internacional. Al ser un sector que afecta directamente a la salud de los ciudadanos, se ha tratado con especial salvaguarda regulándolo de forma muy estricta. Por este motivo, a lo largo del presente trabajo se va a repasar el concepto de farmacia online, así como todos los aspectos fundamentales de una legislación a la altura de las necesidades de la sociedad del siglo XXI. Para ello, se estudiará el origen de estas regulaciones con la sentencia a nivel Internacional del caso DocMorris para luego examinar todos aquellos ordenamientos que han derivado en nuestra legislación nacional y que regulan hoy en día este sector. Se pretende con esto, dominar y comprender mejor el mundo del comercio electrónico de medicamentos, las responsabilidades que hay y las normas que las regulan.

ABSTRACT: Sale at a distance of medicines has been a completely revolution in the pharmaceutical sector at a national and international level. It is a sector that directly affects the health of citizens and for this reason it has always been treated with special safeguards by regulating it very strictly. Therefore, throughout this paper the concept of online pharmacy will be reviewed, as well as all the fundamental aspects of legislation that meets the needs of 21st century society. To do this, the origin of these regulations will be studied with the international ruling of the DocMorris case and then examine all those regulations that have resulted in our national legislation and that regulate this sector nowadays. The aim is to master and better understand the world of electronic medicines commerce, the responsibilities that exist and the rules that regulate them
