La consideración de los legados penales en el Derecho Romano clásico y justinianeo

Abstract

RESUMEN: Este trabajo se centra en los legados, y especialmente aquéllos a título de pena. Esta figura ha creado mucha incertidumbre y lo que se pretende es intentar encontrar una definición de legado a título de pena (poena nomine), entender por qué fueron prohibidos durante la época clásica y por qué luego reinsertados en el ordenamiento justinianeo. Para ello se analizarán estudios de diferentes romanistas sobre este tema y se intentará llegar a los elementos esenciales que crean tanta incertidumbre sobre esta figura. Concluiré respondiendo a la pregunta, ¿pueden ser aceptados hoy en día los legados a título de pena?

ABSTRACT: This work focuses on legacies, specially on those by way of punishment. This figure has created a lot of uncertainty and I will try to find a definition of legacy by way of punishment (poena nomine), and understand why it was forbidden in the classical Age and then reinserted in the Justinian Law. To investigate, I have analyzed studies of different Romanists about this topic and I will try to find out the essential elements which have created so much uncertainty around this figure. I will finish giving an answer to this question: Is it posible to dispose legacies by way of punishment in our present law?
