La prohibición de la tortura y de los tratos inhumanos o degradantes en el Convenio Europeo de Derechos Humanos

Abstract

RESUMEN: El trabajo que nos ocupa, será el análisis jurisprudencial de cuatro sentencias que giran alrededor de la interpretación que hace el tribunal de justicia de la unión europea del artículo 3 del Convenio Europeo de Derechos Humanos. Este artículo como veremos contiene derechos que son pilares fundamentales de las sociedades democráticas. En este trabajo, veremos en concreto como se aplica a diferentes circunstancias, pero con un denominador común, y es la intervención de las Fuerzas y Cuerpos de Seguridad del Estado en la violación de los derechos contenido en el artículo mencionado.

ABSTRACT: The work that concerns us will be the jurisprudential analysis of four judgments that revolve around the interpretation made by the Court of Justice of the European Union of Article 3 of the European Convention on Human Rights. This article, as we shall see, contains rights that are fundamental pillars of democratic societies. In this paper, we will see specifically how it applies to different circumstances, but with a common denominator, and that is the intervention of the State Security Forces and Corps in the violation of the rights contained in the aforementioned article.
