La libertad de impartir religión en los centros educativos

Abstract

RESUMEN: A lo largo de este trabajo se quiere mostrar la evolución de la impartición de la asignatura de religión católica en los centros educativos desde la caída de la dictadura de Francisco Franco hasta hoy en día, realizándose un recorrido histórico de las leyes educativas, haciendo especial mención a lo largo del texto, a la vigente ley de educación denominada LOMLEE. Ley, que ha ocasionado numerosas controversias y sigue siendo actualmente objeto de estudio por la doctrina jurídica. Analizar también, el artículo 27.3 de la Constitución Española donde refiere la libre elección de los padres conforme a su convicción religiosa y, haciendo especial referencia al papel de los profesores tras la aprobación de la ley actual.

ABSTRACT: The aim of this paper is to show the evolution of the teaching of the subject of Catholic religion in educational institution from the fall of the dictatorship of Francisco Franco to the present day, by taking a historical overview of the educational laws, making special mention throughout the text of the current education law known as LOMLEE. This law has caused numerous controversies and is still currently the subject of study by the legal doctrine. It also analyses article 27.3 of the Spanish Constitution, which refers to the free choice of parents in accordance with their religious conviction and makes special reference to the role of teachers after the approval of the current law
