La conciliación previa ante el organismo de resolución extrajudicial de conflictos laborales de Cantabria

Abstract

RESUMEN El presente trabajo trata sobre la conciliación previa en España. En él se exponen desde los precedentes históricos hasta la última normativa sobre conciliación, recogida en la Ley Reguladora de la Jurisdicción Social de 2011. Se explica cómo ha ido evolucionando a lo largo de las distintas proposiciones legislativas y cuál ha sido la creación, desarrollo y transformación de los distintos órganos conciliadores. A continuación, se comentan los procedimientos del acto de conciliación, los efectos que produce y, finalmente, sus posibles consecuencias. También, se hace un análisis del VI Acuerdo Interprofesional de Cantabria sobre Resolución Extrajudicial de Conflictos Laborales y el Organismo Extrajudicial de Resolución de Conflictos Laborales de Cantabria (ORECLA).

ABSTRACT The topic of this dissertation relates to pretrial reconciliation in Spain. It will be covering several facts, from the historical precedents to the last regulation regarding reconciliation, contained in the Regulatory Law of Social Jurisdiction from 2011. It will also explain how it has been evolving throughout the different legislative proposals, and the process of the creation, development, and transformation of the distinct conciliatory entities. Following said topic, it will also explore the different stages of the conciliatory act; its procedures, the effects it may cause and the possible consequences it might lead to. Lastly, an analysis is made regarding the VI Inter-branch Agreement of Cantabria regarding the Out-of-court Settlement of Labor Disputes and the Extrajudicial Agency of Labor Dispute Resolution of Cantabria (ORECLA).
