La acción rescisoria concursal

Abstract

Resumen. El presente escrito pretende llevar a cabo un análisis crítico de la acción rescisoria concursal en nuestro ordenamiento jurídico. Comenzaremos este trabajo examinando el concepto y la finalidad de la acción para después estudiar la misma en la actual Ley Concursal. Posteriormente, indagaremos en los requisitos para el ejercicio de la acción así como en los actos y negocios jurídicos que constituyen el objeto de la misma. Por último, nos aproximaremos a la rescisoria concursal desde el punto de vista procesal.

Abstract: This writing intends to carry out a critical analysis of the insolvency rescission action in our legal system. We will begin this work by examining the concept and purpose of the action and then studying it in the current Bankruptcy Law. Subsequently, we will investigate the requirements for the exercise of the action as well as the legal acts and legal businesses that constitute the object of the same. Finally, we will take an approach to this action from the procedural point of view.
