La protección de los mayores de edad con discapacidad en el derecho internacional privado español

Abstract

Resumen: El presente trabajo tiene por objeto analizar la protección de los mayores de edad con discapacidad desde la perspectiva del Derecho Internacional Privado español. Partiendo del concepto de discapacidad tanto en el Derecho Internacional como el del considerado en el ordenamiento jurídico español. Posteriormente, se realiza una visión general de los siguientes instrumentos internacionales que son, en primer lugar, la Convención de Naciones Unidas sobre los derechos de las personas con discapacidad hecha en Nueva York el 13 de diciembre de 2006 (CNUDPD) y, en segundo lugar, el Convenio de La Haya sobre la protección internacional de adulto de 13 de enero de 2000 (HAPC), formando únicamente parte del ordenamiento jurídico español, el primero. Seguidamente, se analiza la competencia judicial internacional, la ley aplicable a las medidas de protección de los mayores de edad, la validez extraterritorial de decisiones judiciales extranjeras y de documentos públicos internacionales y la cooperación internacional, comparando lo aplicable en España y lo establecido en el HAPC. Y, por último, se observa el contenido de la Estrategia Europea de Discapacidad de 2010-2020 y la 2021-2030.

Abstract: The aim of this Project is to analyze the protection of adults with disabilities from the perspective of Spanish Private International Law. Based on the concept of disability both in International Law and that considered in the Spanishlegal system. Subsequently, an overview is given of the following international instruments which are, first, the United Nations Convention on the Rights of Persons with Disabilities, done in New York on 13 December 2006 (UNCSD) and, secondly, the Hague Convention on the International Protection of Adults of 13 January 2000 (HAPC), forming only part of the Spanish legal order, the first. It then analyses international jurisdiction, the law applicable to measures for the protection of adults, the extraterritorial validity of foreign judicial decisions and international public documents and international cooperation, comparing what is applicable in Spain and what is established in the PEF. Finally, the content of the European Disability Strategy 2010-2020 and 2021-2030 is observed.
