Resumen: La identificación mediante perfiles de ADN ha supuesto una auténtica revolución en las investigaciones criminales en los últimos años, no solo en la identificación de autores de hechos delictivos, sino también en la exculpación de sujetos inocentes. La utilización de marcadores de ADN tiene un régimen legal confuso y disperso, ocasionando la necesidad de colmar las diversas lagunas con jurisprudencia, en ocasiones, contradictoria. La problemática que surge del análisis del ADN, fundado en el debido respeto a las garantías constitucionales, supone, en nuestro Estado de Derecho, todo un reto para la justicia penal y Derecho Procesal.
Abstract: Identification through DNA profiles has been a real revolution in criminal investigations in recent years, not only in the identification of perpetrators of criminal acts, but also in the exoneration of innocent subjects. The use of DNA markers has a confusing and dispersed legal regulation, causing the need to fill the legal loopholes with jurisprudence, sometimes contradictory. The problem that arises from DNA analysis, which must respect constitutional guarantees, represents, in our State of Law, a challenge for criminal justice and procedural law.
