La pensión de alimentos : Evolución legislativa y jurisprudencial

Abstract

Resumen: El trabajo realiza un análisis de los aspectos más generales sobre la pensión de alimentos y su evolución legislativa hasta la actualidad. En concreto, se examina la Sentencia del Tribunal Supremo 502/2019, de 19 de febrero de 2019. Se trata de un pronunciamiento significativo puesto que profundiza en las relaciones de afectividad entre alimentante y alimentista y valora la posibilidad de extinguir la pensión de alimentos por la nula relación de afectividad entre el progenitor y la menor. También efectúa una comparación entre el Derecho Común y el Derecho foral de Cataluña y de Aragón, los cuales contemplan este asunto.

Abstract: The work carries out an analysis of the most general aspects of the alimony and its legislative evolution up to the present time. Specifically, Supreme Court Sentence 502/2019, of February 19, 2019 is examined. It is a significant pronouncement since it delves into the affective relationships between obligor and obligee and assesses the possibility of extinguishing alimony for the null affective relationship between the parent and the minor. It also makes a comparison between the Common Law and the Foral Law of Catalonia and Aragon, which contemplate this matter.
