Análisis de la desheredación en el ordenamiento jurídico español

Abstract

RESUMEN: En nuestro Ordenamiento Jurídico, el Derecho de Sucesiones es la parte del derecho Privado encargada de regular las relaciones jurídicas de una persona cuando ésta muere. Dentro del mismo encontramos con la desheredación, institución por la cuál se priva a un heredero forzoso de cuantos derechos legitimarios pudieran corresponderle. En este trabajo se analiza la regulación de esta figura, no sólo en el Derecho Común, si no también en los territorios con Derecho Foral, así como las particularidades que presentan algunos países en esta materia (derecho Comparado). Dado que la desheredación es una figura un tanto conflictiva, se ha propuesto una reforma de nuestro Código Civil que, en este trabajo, se comenta y que, de llegar a producirse, provocaría un gran cambio, no sólo en el Derecho Sucesorio, si no en todo nuestro Derecho Civil tal y cómo lo conocemos. ABSTRACT : In our Legal System, Succession Law is the part of Private Law in charge of regulating the legal relationships of a person when he or she dies. Within it we find disinheritance, an institution by which a forced heir is deprived of all the legitimate rights that may correspond to him. This work analyzes the regulation of this figure, not only in Common Law, but also in the territories with Foral Law, as well as the particularities that some countries present in this matter (Comparative Law). Given that disinheritance is a somewhat conflictive figure, a reform of our Civil Code has been proposed that, in this work, is commented and that, if it were to occur, would cause a great change, not only in the Succession Law, if not in all our Civil Law as we know it.
