Los orígenes de la justicia en España: la Ley Orgánica del Poder Judicial de 1870

Abstract

RESUMEN: La justicia, en la sociedad humana en general, y en la sociedad española en particular, es el elemento vertebrador principal para que la misma funcione y tenga éxito. Pero a lo largo de nuestra historia, esta ha variado en demasía. El trabajo que se expone posteriormente intenta ilustrar al lector sobre los principales cambios y características que acontecen a nuestra justicia y su desarrollo, partiendo del derecho consuetudinario, pasando por el derecho común, el derecho real y la ilustración, para llegar al S.XIX, siglo con los más importantes cambios en el ámbito de la justicia, que finalmente conforman la base del trabajo y de nuestro sistema judicial actual: la Ley Orgánica del Poder Judicial de 1870, madre de la ahora aplicable LOPJ de 1985.

ABSTRACT: Justice, generally in human’s society and particularly in the Spanish society, is the skeleton and main element for it to work and succeed. But all in all, throughout our history, this has shift excessively. The assignment that will be exposed later on tries to show the reader the mayor changes and features that both our justice and its development have suffered, starting with the customary law, passing across the common law, royal law and the enlightenment, arriving to the XIX century, the age with the greatest changes in the justice field, which finally make up the work´s and justice system base: the 1870 'Ley Orgánica del Poder Judicial', mother of the actual LOPJ of 1985.
