Efectos de los juicios paralelos sobre el proceso penal español

Abstract

RESUMEN: El presente trabajo se centra en el fenómeno de los juicios paralelos y sus efectos sobre el proceso, dividiéndose su desarrollo en tres capítulos. En el primero, analizamos el concepto, características y surgimiento, con una breve alusión a la influencia que tienen las redes sociales. En el segundo, nos centramos en el estudio de los efectos procesales durante la fase de instrucción, estudiando el principio de publicidad y sus límites, especialmente la figura del secreto de sumario, y porqué esta no resulta eficaz. En el tercer y último capítulo, desarrollamos la afectación durante la fase de juicio oral, analizando su influencia sobre el principio de imparcialidad del juez, la presunción de inocencia, el Derecho de defensa, y finalmente, la sentencia y el valor del derecho al olvido, como arma contra los efectos sociales del juicio paralelo.

ABSTRACT: This work focuses on the phenomenon of parallel trials and its effects on the process, dividing its development into three chapters. In the first, we analyze the concept, explaining its characteristics and emergence, with a brief allusion to the influence that social networks have on it. In the second, we focus on the study of procedural effects during the summary phase, studying the principle of publicity and its limits, especially the figure of summary secrecy, with an analysis of why this does not work at all. In the third and last chapter, we develop the impact during the oral trial phase, analyzing its influence on the principle of impartiality of the judge, the presumption of innocence, the right to defense, and finally, the sentence and the value of the right to be forgotten , as a weapon against the social effects of the parallel trial.
