La crisis jurídica del teletrabajo en tiempos de pandemia

Abstract

RESUMEN: A lo largo de las siguientes páginas, voy a abordar jurídicamente uno de los grandes protagonistas de la crisis sanitaria del COVID-19, el teletrabajo. Una modalidad de trabajo a distancia preexistente y realmente implementada hace décadas, pero necesitada de una regulación autónoma suficiente y certera. Una regulación que nace de la excepcional situación que vivimos, la pandemia del COVID-19, un hecho histórico en el panorama nacional que ha marcado un ANTES y un DESPUÉS para los teletrabajadores. Por este motivo último y con el objetivo de establecer un orden coherente, pero a la vez novedoso, este trabajo final se divide en tres partes que están basadas exclusivamente en los distintos periodos de tiempo que nos ha dejado la pandemia del COVID-19: • Una introducción , el teletrabajo DURANTE el COVID-19. • Un primer capítulo, el teletrabajo ANTES del COVID-19. • Un segundo capítulo, el teletrabajo DESPUÉS del COVID-19.

ABSTRACT: Throughout the following pages, I am going to legally address one of the protagonists of the COVID-19 sanitarian crisis, telecommuting. A preexisting way of remote working and actually implemented decades ago, but in need of a self sufficient and accurate regulation. A regulation which rises from the exceptional situation we live in, the COVID-19 pandemic, a historic event in the national scene that has marked a BEFORE and an AFTER for teleworkers. For this reason and with the aim of establishing a coherent order, but novel at the same time, this final work is divided into three parts that are based exclusively on the different periods of time that the COVID-19 pandemic has left us: ● An introduction, teleworking DURING COVID-19. ● A first chapter, teleworking BEFORE COVID-19. ● A second chapter, teleworking AFTER COVID-19.
