La protección jurídica del menor migrante y refugiado en el marco de las Naciones Unidas: principios básicos.

Abstract

RESUMEN: Siempre que existen desplazamientos migratorios los niños son unas víctimas especialmente vulnerables. El objetivo principal de esta investigación ha sido analizar los instrumentos normativos más relevantes que ofrece la Organización de las Naciones Unidas para proteger y garantizar los derechos de los niños migrantes y refugiados. Se han estudiado los diferentes conceptos de niño, migrante y refugiado en el plano internacional. Así como la evolución de la normativa internacional dirigida al menor haciendo hincapié en el análisis de la Convención sobre los Derechos del Niño, centrándonos en el estudio de dos principios básicos que ésta recoge: el principio de no discriminación e igualdad y el principio del interés superior del niño. Finalmente, se llegará a la conclusión de que esta protección es escasa, proponiendo una reforma y actualización de este que atienda de forma más exacta a las necesidades de estos menores involucrados en los desplazamientos.

ABSTRACT: Whenever there are migratory movements, children are especially vulnerable victims. The main objective of this research has been to analyze the most relevant normative instruments offered by the United Nations to protect and guarantee the rights of migrant and refugee children. The different concepts of child, migrant and refugee have been studied at the international level. As well as the evolution of international regulations aimed at minors, with special emphasis on the analysis of the Convention on the Rights of the Child, focusing on the study of two basic principles that it includes: the principle of non-discrimination and equality and the principle of best interests of the child. Finally, it will be concluded that this protection is scarce, proposing a reform and updating of the same that more exactly meets the needs of these minors involved in displacement.
