Luces y sombras del agente encubierto informático.

Abstract

RESUMEN: El presente trabajo se centra en la figura del agente informático encubierto, dividiéndose su estudio en cuatro capítulos. En los primeros analizamos lo relativo al propio sujeto en sí; su concepto, surgimiento y relación con el agente encubierto en terreno físico, o protección de su identidad por la labor realizada para después pasar a analizar, en los capítulos posteriores, desde la perspectiva procesal, aspectos que presentan una relevancia determinante. En concreto, nos centraremos en las normas y los procedimientos que deben seguir sus actuaciones, los límites que encuentran estas, así como la eventual responsabilidad que pueda surgir de su actuación o el propio valor de las pruebas obtenidas de cara al enjuiciamiento de los delitos investigados.

ABSTRACT: The following paper has the figure of the covert informatic agent as its focus, and is composed by four chapters. The first will analyse the agent itself, its concept, upbringing, and its relation with the physical covert agent or the protection of its identity through the task. In latter chapters, it will analise aspects/topics of utmost relevance through procedural perspective. Precisely, this paper will tackle the norms and procedures the covert informatic agent must follow in its tasks, their limits, and the eventual responsability that may arise from their task or the value of the evidences obtained for the prosecution of the crimes investigated.
