El impuesto catalán sobre viviendas vacías

Abstract

Resumen: En el presente trabajo se describirán los elementos fundamentales del impuesto sobre viviendas vacías de Cataluña, haciendo hincapié en los objetivos buscados por el tributo, su fin social de protección del derecho al acceso a la vivienda, así como un análisis constitucional derivado de la reciente sentencia del Tribunal Constitucional 4/2019, de 17 de enero de 2019. También se abordarán otros aspectos vinculados estrechamente al mismo, como la trayectoria del concepto de vivienda vacía y su importancia para entender el impuesto; su similitud y diferencias con otras figuras impositivas que afectan a la vivienda vacía; y la transcendencia de la función extrafiscal en los tributos, y, en concreto, en el impuesto sobre viviendas vacías de Cataluña.

Abstract: In the present work it will be developed the fundamental aspects of the tax of empty housing of Catalonia, emphasizing the objectives wanted by the tribute, its social purpose of protecting the right to access to housing, as well as a constitutional analysis derived from the recent judgment of the Constitutional Court 4/2019, of 17 January 2019. Other closely related considerations will also be addressed, as the trajectory of the concept of empty housing and it's importance for understanding the tax; it's similarity and differences with other tax figures that affect empty housing; and the transcendence of extrafiscality function in taxes, and, specifically, in the empty housing tax of Catalonia
