RESUMEN: En el presente trabajo se ha llevado a cabo un estudio de la partición de la herencia, es decir, el procedimiento por el que se pone fin a la comunidad hereditaria. En primer lugar, he analizado la figura del contador-partidor junto con el albacea, es decir, la figura del administrador de la herencia. En segundo lugar, he descrito el proceso de la partición hereditaria, con las operaciones particionales a realizar por el contador-partidor. También se han examinado los efectos de la partición. En tercer lugar, se ha llevado a cabo un listado de documentación necesaria para realizar un cuaderno particional. Además, también se han analizado los requisitos básicos que todo cuaderno particional ha de tener. En cuarto lugar, se ha realizado un estudio sobre el procedimiento de división judicial de herencia. Posteriormente se adjunta un modelo de cuaderno particional aprobado judicialmente en el que se han analizado todos los puntos de su estructura. Por último, se adjunta una demanda de liquidación de la sociedad de gananciales y de división judicial de herencia, que es el paso previo a la realización del cuaderno particional por un contador-partidor designado judicialmente.
ABSTRACT: In the present work, a study of the partition of inheritance has been carried out, that is, the procedure by which the hereditary community is ended. In the first place, I have analyzed the figure of the accountant-divider together with the executor, that is, the figure of the administrator of the estate. Second, I have described the hereditary partitioning process, with the partition operations to be performed by the counter-partitioner. The effects of partitioning have also been examined. Third, a list of necessary documentation has been carried out to make a partition notebook. In addition, the basic requirements that every partition notebook must have have also been analyzed. Fourth, a study has been carried out on the procedure for the judicial division of inheritance. Subsequently, a model of a judicially approved partition notebook is attached, in which all the points of its structure have been analyzed. Finally, a demand for the liquidation of the community property and judicial division of inheritance is attached, which is the step prior to the completion of the partition notebook by a judicially appointed accountant-divider.
