Abstract

RESUMEN: En una sociedad como la actual tan globalizada, es habitual el hacer turismo a lugares cada vez más inhóspitos y con unos medios más seguros. Sin embargo, ello no está exento de incumplimientos por parte de los operadores turísticos, ocasionando en algunos casos daños y perjuicios al usuario. En este contexto, destaca la importancia en los últimos años del contrato de viaje combinado que plantea cuestiones interesantes a la hora de dirimir la responsabilidad de los operadores turísticos por el incumplimiento o cumplimiento defectuoso de sus obligaciones contractuales o por los daños que haya sufrido el viajero durante la ejecución del contrato. Los principales problemas se dan como consecuencia de que quienes se encargan de prestar los distintos servicios que engloba el paquete turístico son empresas distintas de aquellas con las que el cliente contrata directamente.

ABSTRACT: In such a globalised society, it is becoming increasingly common to go on holiday to inhospitable places, while using safer means of transport. However, this is not exempt from contract breaches by tourist operators, causing damages and inconvenience to the consumer. For this reason, combined travel contracts have become increasingly prominent in recent years as they raise important questions regarding the acceptance of liability by tourist operators in the event of breach of or non-compliance with their contractual obligations, or due to damages suffered by the traveller during the life of the contract. The main problems arise when those who are responsible for offering the different services that make up the travel package are not the companies with which the client has initially contracted.
