La figura de la legítima hereditaria en el derecho español

Abstract

RESUMEN: El presente trabajo consiste en el análisis de la institución de la Legítima en España. Hablaremos de la naturaleza de la misma y de quiénes son los herederos forzosos. Se analizará su regulación tanto en el Código Civil como en las distintas regiones forales existentes en nuestro país y se hará una breve referencia de la misma en Derecho comparado. Por último, haremos mención a la necesidad de una reforma del sistema de legítimas en base a las nuevas circunstancias económicas y sociales en las que vive nuestro país.

ABSTRACT: This essay consists of an analysis of the institution of forced inheritance in Spanish law. We will discuss its nature and who the forced heirs are. Its regulation will be analysed both in the Civil Code and in the different foral regions existing in our country, and a brief reference will be made to it in comparative law. Finally, we will talk about the need for a reform that should consist in a review of the compulsory shares and the causes of disinheritance, so they could be adapted to the new social and economic circumstances that nowadays our country lives on.
