El tribunal del jurado en España y en el derecho comparado anglosajón

Abstract

RESUMEN: En este trabajo se aborda la institución del tribunal del jurado, comenzando por la proyección histórica del mismo en el derecho español, analizando cual fue su origen, así como su abolición y nueva incorporación al sistema a lo largo de los diferentes periodos de la historia de España. De seguido se tratan ciertos elementos de la institución, tales como el veredicto y la sentencia, además de analizar los distintos sistemas de jurados existentes para concretar cual es el escogido por el legislador español. En último lugar, se hace un estudio sobre la institución en el derecho anglosajón, esto es en Estados Unidos y en el Reino Unido, dado que la misma tiene un mayor calado en sendos sistemas jurídicos

ABSTRACT: In this paper, the institution of the jury tribunal is approached, beginning with its historical projection in Spanish law, analyzing its origin, as well as its abolition and new incorporation into the system throughout the different periods of the history of the jury in Spain. Then, certain elements of the institution are discussed, such as the verdict and the sentence, in addition to analyzing the different existing jury systems to specify which is the one chosen by the Spanish legislator. Lastly, a study is made of the institution in Anglo-Saxon law, that is, in the United States and the United Kingdom, since it has a greater depth in both legal systems.
