Una encomienda atípica a TRAGSA: extramuros de su objeto social y por convenio

Abstract

RESUMEN: El presente estudio analiza una reciente encomienda de gestión a TRAGSA para la limpieza de un hospital público, hasta el momento en que se adjudique un nuevo contrato, detectándose en aquella una doble anomalía, de fondo y de forma. La anomalía de fondo se encuentra en el objeto de la encomienda, pues la limpieza de una infraestructura sanitaria urbana no tiene cabida en el objeto social de TRAGSA, que se ciñe al ámbito rural. La anomalía de forma está en su instrumentación mediante un convenio, que se encuadra erróneamente en el convenio de encomienda de gestión del artículo 15 de la LRJ-PAC -que se refiere al posible acuerdo bilateral y voluntario de asistencia administrativa, no contractual, en el ejercicio de competencias propias de los órganos administrativos o de los entes públicos- mientras que la encomienda de gestión a TRAGSA debe encajarse en las encomiendas de los artículos 4.1.n) y 24.6 del TRLCSP, que se instrumentan mediante orden de servicio del poder adjudicador Dirigida a su medio instrumental, como un mandato unilateral, no negociable y de obligado cumplimiento por aquel.

ABSTRACT: This study analyzes a recent management commission to TRAGSA for cleaning a public hospital, until such time that a new contract is awarded, detected in this double anomaly, in form and substance. The anomaly substantive is the object of the commission, because the cleaning of urban health infrastructure has no place in the social object of TRAGSA, which is linked to rural sectors. The anomaly of the form is in its implementation by a covenant, being wrongly framed in the management commission referred to in article 15 of the LRJ-PAC -regards the posible bilateral and voluntary agreement on administrative assistance, not contractual, in exercising its own powers of administrative bodies or public entities- whilst the management commission to TRAGSA must fit in commissions referred to in articles 4.1.n) and 24.6 of TRLCSP, that are implemented through service order of the contracting authority directed to its an instrumental means, as a unilateral mandate, non-negotiable and as an obligatory component by that.
