Inteligencia artificial y robótica: responsabilidad civil y penal de los robots

Abstract

RESUMEN: A medida que el mundo evoluciona, nosotros evolucionamos con él. No es, por tanto, exagerado, plantarse la posibilidad de que, en un futuro, seres humanos y robots convivan mano a mano socialmente. La IA y concretamente, el campo de la robótica, nunca han dejado de ser objeto de investigación y transformación, siendo progresivos los avances alcanzados en esta materia. Por ello, el objetivo de este trabajo es abordar algunos de los interrogantes que este asunto plantea, desde qué se entiende cuando hablamos de robot o cuáles son los distintos modelos existentes, hasta la viabilidad o no de conceder una personalidad jurídica propia a estas máquinas, dotándoles de unas normas específicas que las regulen, o si sería lícito considerarlas responsables civiles y penales de los actos que cometan. Cada vez son mayores las consideraciones de la Unión Europea sobre esta nueva alternativa, así como la opinión de algunos autores relevantes en la materia. En consecuencia, haremos referencia a todo ello.

ABSTRACT: As the world evolves, we evolve with it. Therefore, it isn’t an exaggeration to consider the possibility that, in the future, humans and robots coexist socially hand in hand. AI and specifically, the field of robotics, have never ceased to be the object of research and transformation, the progress made in this area being progressive. Therefore, the objective of this work is to address some of the questions that this matter raises, from what is understood when we talk about robots or what are the different existing models, to the viability or not of granting a legal personality of its own to these machines, providing them with specific norms to regulate them, or if it would be lawful to consider them civil and criminal responsible for the acts they commit. European Union's considerations on this new alternative are increasing, as well as the opinion of some relevant authors on the matter. Consequently, we will refer to all of this.
