El impacto de la pandemia del COVID-19 en los arrendamientos de locales comerciales: moratoria y posible aplicación de la cláusula rebus sic stantibus

Abstract

RESUMEN: En el presente trabajo se pretende aportar una visión tanto teórica como práctica, incorporando las últimas resoluciones judiciales dictadas por los diferentes tribunales españoles, en relación con las moratorias en el pago de rentas derivadas de contratos de locales de uso distinto al de la vivienda habitual, todo ello debido a la situación que trae causa de la pandemia mundial causada por el virus del COVID-19 vivida en los últimos meses. Los cambios en todos los aspectos de la vida y que nos ha hecho cambiar nuestra visión y manera de disfrutar de ella, han motivado la realización del presente estudio. El trabajo se realizará, basándome en la normativa que se ha dictado al respecto, así como en doctrina y reciente jurisprudencia, procurando, en todo momento, tratar de dar una solución lo más adecuada y lógica posible a las diversas situaciones que pueden traer causa de esta crisis. La falta de una regulación ajustada a la situación extraordinaria sufrida puede llegar a colapsar el sistema jurídico español, algo que me preocupa como estudiante y espero, como futura abogada que se dedique al ejercicio de una profesión tan compleja y a la vez tan bonita.

ABSTRACT: The purpose of this project is to provide both a theoretical and practical vision, incorporating the latest judicial decisions issued by the different Spanish courts, in relation to the moratoriums in the payment of rents derived from contracts for premises of use other than that of the habitual residence, all due to the situation caused by the global pandemic caused by the COVID-19 virus experienced in recent months. The changes in all aspects of life and that have made us change our vision and way of enjoying it, have motivated the carrying out of this study. The work will be carried out, based on the regulations that have been issued in this regard, as well as on doctrine and recent jurisprudence, trying, at all times, to try to provide the most appropriate and logical solution possible to the various situations that may bring cause of this crisis. The lack of a regulation adjusted to the extraordinary situation suffered can lead to the collapse of the Spanish legal system, something that worries me as a student and I hope, as a future lawyer, that she dedicates herself to the exercise of such a complex and at the same time beautiful profession.
