Menores transexuales: realidad jurídica y feminismo

Abstract

RESUMEN: El presente trabajo de investigación estudia la transexualidad infantil desde un punto de vista jurídico, a través del análisis de la Ley 3/2007, de la normativa complementaria y de la jurisprudencia, hasta llegar a la STC 99/2019, que permite a los menores “con suficiente madurez” y “en situación estable de transexualidad” modificar la mención registral del sexo. Expone, asimismo, tras el anuncio de la futura Ley Trans de carácter estatal, la visión que las diferentes corrientes feministas tienen sobre el reconocimiento de la identidad de género.

ABSTRACT: This research work studies child transsexuality from a legal point of view, through the analysis of the Organic Law 3/2007, complementary regulations and jurisprudence, until reaching the Constitutional Court Sentence 99/2019, which allows minors "with sufficient maturity" and "in a stable situation of transsexuality" to modify the sex registral reference. It also explains, after the announcement of the future State Transsexual Act, the vision that the different feminist currents have on the recognition of gender identity.
