La UE y la creación de una corte internacional de inversiones

Abstract

RESUMEN: La creación de una Corte Internacional de Inversiones es una idea en desarrollo en el seno de la Unión Europea desde hace algunos años. Recientemente, con la emisión del Dictamen 1/17 por parte del Tribunal de Justicia de la Unión Europea, esa idea parece más cercana que nunca, pues se ha declarado compatible con el Derecho de la Unión Europea la creación de una corte bilateral de inversiones en el marco del acuerdo CETA entre la Unión Europea y Canadá. A lo largo de este trabajo profundizaremos en las implicaciones de este Dictamen. Para ello, consideraremos el sistema actual de arbitraje internacional de inversiones para indagar en las implicaciones de este Dictamen que supone el colofón del CETA, concebido como el primero de una serie de acuerdos bilaterales de nueva generación que culminarían con la creación, en un marco multilateral, de una Corte Internacional de Inversiones.

ABSTRACT: The creation of an International Investment Court has been an idea in development in the core of the European Union since a few years ago. Recently, with the publication of the Opinion 1/17 from the Court of Justice of the European Union, this idea seems closer than ever, since it finds compatible with the primary law of the European Union the creation of a bilateral investment court in the framework of the CETA deal between the European Union and Canada. Throughout this work we will go in depth in the implications of this Opinion. For this purpose, we’ll consider the current system of international investment arbitration in order to look into the implications of this Opinion which means the culmination of the CETA, conceived as the first of a series of new generation bilateral agreements that culminates with the creation -in a multilateral framework- of an International Investment Court
