Los principales incumplimientos contractuales de las empresas de transporte

Abstract

RESUMEN: El Turismo es considerado el pilar fundamental del desarrollo de las economías alrededor del mundo. Incluso, se considera que los países más desarrollados son aquellos que basan su economía en los servicios, especialmente, en lo que respecta al turismo. En este sentido, España se presenta como el segundo destino turístico de todo el planeta, solo después de Estados Unidos, lo cual evidencia la importancia , tanto económica como social , que tiene este sector para los españoles . Asimismo, debido a la importancia, el sector del turismo, afecta diferentes ámbitos del país, como lo son los ámbitos políticos, ámbitos sociales, culturales, económicos, entre otros. Por lo tanto, se hace necesario que el mismo cuente con una regulación legal que contribuya con la organización y las transacciones que se realizan en esta área. Por otro lado, cabe destacar que existen diferentes relaciones jurídicas que se generan a partir del turismo y estas mismas son establecidas por medios contractuales y, uno de ellos , es el contrato de transporte turístico , el cual , a pesar de ser establecido de forma legal , en muchas ocasiones presenta incumplimientos por parte de las empresas turísticas que prestan este tipo de servicios. De esta manera en el presente estudio se pretende desarrollar la noción de incumplimiento contractual en la industria de transporte de pasajeros.

ABSTRACT: Tourism is considered the fundamental pillar of the development of economies around the world. Even, it is considered that the most developed countries are those that base their economy on services, especially in regard to tourism. In this sense, Spain appears as the second tourist destination of the entire planet, only after the United States, which shows the importance, both economic and social , that this sector has for the Spanish. Also , due to its importance , the tourism sector affects different areas of the country , such as political areas , social , cultural , economic, among others . Therefore, it is necessary that it has a legal regulation that contributes to the organization and the transactions that are carried out in this area. On the other hand, it should be noted that there are different legal relationships that are generated from tourism and these are established by contractual means and, one of them, is the tourism transport contract, which, despite being established in a legal , often presents breaches by tourism companies that provide this type of service . In this way, the present study aims to develop the notion of contractual breach in the passenger transport industry.
