Nulidad de la inscripción empresarial / validez de la cotización laboral.

Abstract

RESUMEN. La nulidad de la inscripción no invalida los efectos de la cotización para el trabajador, la entidad gestora puede actuar de oficio porque no se afecta a ningún acto declarativo de derechos en perjuicio del beneficiario y aquélla ha de anticipar la pensión, previa declaración de responsabilidad empresarial en el abono de la misma, toda vez que se aprecian irregularidades ("anomalías") en los actos de encuadramiento y cotización, pero no ausencia de los mismos.

ABSTRACT. The nullity of the registration does not invalidate the effects of the contribution for the worker, the managing entity can act ex officio because it does not affect any declaration of rights to the detriment of the beneficiary and it has to anticipate the pension, after a declaration of corporate responsibility in the payment of the same, whenever irregularities ("anomalies") are observed in the framing and listings acts, but not absence thereof.
