Nuevos modelos de familia: revisión del régimen jurídico de las parejas de hecho

Abstract

RESUMEN: El presente trabajo de investigación aborda, desde una perspectiva autonómica, nacional e internacional, la institución de las parejas de hecho, centrándose en el estudio de este modelo familiar en el Ordenamiento Jurídico español. El Derecho Civil es su enfoque principal, aunque debido a su perfil multidisciplinar se abordan cuestiones de Derecho Constitucional, Internacional Privado y Administrativo. La presente Tesis Doctoral analiza la abundante y heterogénea normativa en esta materia, deteniéndose en aquellos aspectos más controvertidos y que suscitan un mayor reto para el campo del Derecho, tales como la atribución del uso de la vivienda familiar, los derechos sucesorios de los integrantes de la pareja de hecho o la sospechosa constitucionalidad de su normativa autonómica, entre otras cuestiones. A lo largo del trabajo de investigación se analizan de manera crítica todas estas materias aportando, finalmente, diversas soluciones a la problemática jurídica que se presenta en torno a este modelo de familia.

ABSTRACT: This research addresses, from an autonomous, national and international perspective, the institution of domestic partnerships, focusing on the study of this family model in the Spanish Legal System. Civil Law is its focus, although due to its multidisciplinary profile, issues of Constitutional, Private International and Administrative Law are addressed. This Doctoral Thesis analyses the abundant and heterogeneous regulations in this matter, stopping on those aspects that are most controversial and that raise a greater challenge for the field of Law, such as the attribution of the use of the family home, the inheritance rights of the members of the de facto partner or the suspicious constitutionality of its autonomous regulations, among other issues. Throughout the research work, all these matters are critically analysed, finally providing various solutions to the legal problems that arise around this family model.
