Verba, mens, ratio: Fernando Rebello sobre la interpretación del ius scriptum

Abstract

RESUMEN. Este trabajo analiza la quaestio De recta ratione interpretandi ius scriptum del jesuita portugués Fernando Rebello (1608). Empeño novedoso en un autor de la Escuela de Salamanca, la quaestio no pasa de ser una modesta síntesis de la doctrina común del momento sobre la interpretación de la ley. En Consecuencia, muestra las mismas limitaciones que esa doctrina en lo tocante a la individualización de los componentes de la ley -en particular la mens y la ratio legis- y al significado de sus múltiples interacciones. El resultado último es la relativización del rol decisorio atribuido a la ratio legis en las operaciones hermenéuticas en general.

ABSTRACT. This article analyzes the quaestio De recta ratione interpretandi ius scriptum of the Portuguese Jesuit Fernando Rebello (1608). Novel effort in an author of the School of Salamanca, the quaestio is nothing more than a modest synthesis of the common doctrine of the moment on the interpretation of the law. Consequently, it shows the same limitations as that doctrine with respect to the individualization of the components of the law -in particular the mens and the legis ratio- and to the meaning of their multiple interactions. The final result is the relativization of the decisionmaking role attributed to the legis ratio in hermeneutical operations in general.
