La persistencia del proceso soberanista ante el Tribunal Constitucional

Abstract

RESUMEN: El presente trabajo es la segunda parte de un artículo previo en el que se analiza la jurisprudencia del Tribunal Constitucional sobre el proceso soberanista catalán, desde el 27 de octubre de 2017 hasta el 1 de abril de 2020. Se trata de una estudio que sigue un orden temporal de los acontecimientos en el que se llama primeramente la atención sobre aquellas cuestiones políticas e institucionales relacionadas con la defensa de la Constitución y la democracia. En segundo lugar, se abordan los principales temas vinculados con los recursos de amparo presentados ante el Tribunal Constitucional por los políticos independentistas que fueron juzgados ante el Tribunal Supremo por rebelión, sedición y malversación, entre otros tipos delictivos.

ABSTRACT: This work is the second part of a previous paper in which we analyze the jurisprudence of the Spanish Constitutional Court on the Catalan sovereignty process. The period covers from October 2017 to April 2020. It is a synchronous study that focuses on those political and institutional issues related to the defense of the Constitution and democracy. In addition, we study the main issues related to the appeals presented to Constitutional Court by pro —independence politicians who were tried before the Spanish Supreme Court for crimes of different nature.
