Análisis del artículo 183 quater del código penal español. La “cláusula de Romeo y Julieta”

Abstract

RESUMEN: El presente trabajo, pretende realizar un estudio de las diversas reformas efectuadas por el Código Penal en el ámbito de los delitos sexuales a menores, centrándose en la elevación de la edad de consentimiento sexual, con la consiguiente aparición de la cláusula prevista en el artículo 183 quater del Código Penal y lo que ello conlleva. Se pretende hacer un análisis de dicha cláusula, hablando no sólo de la naturaleza jurídica de la misma, sino, también, de los requisitos necesarios para su aplicación. Así mismo, se analizará el tratamiento que la jurisprudencia ha dado a la cláusula.

ABSTRACT: The following report seeks to develop a study of the reforms made by the Criminal Code in the area of sexual offences against minors, focusing on raising the age of sexual consent, with the consequent appearance of the clause provided for in Article 183quater of the Penal Code and what this entails. The aim is to analyse this clause, not only in terms of the legal nature of it, but also in terms of the requirements for its application. It will also analyse the treatment that jurisprudence has given to the clause.
