Violencia sexual contra mujeres y niñas refugiadas y solicitantes de asilo

Abstract

RESUMEN:El presente Trabajo Fin de Grado tiene por objeto el estudio del problema de la violencia sexual contra mujeres y niñas refugiadas y solicitantes de asilo, una realidad que continúa pese a los esfuerzos realizados por muchos Estados y por el ACNUR. Para ello, se analizará el uso de esta violencia en situaciones de conflicto, en las rutas y en los países de destino; examen que se manifiesta complejo por la falta de datos confiables sobre su extensión y magnitud a causa de las circunstancias caóticas y por la renuencia de las propias mujeres a denunciarla, bien por temor a nuevas represalias o bien por el estigma a ella asociado. Haciendo uso de la perspectiva feminista como herramienta metodológica de análisis jurídico, se valorarán asimismo las urgentes medidas para combatir y prevenir este tipo de violencia, habida cuenta de que, a pesar de los avances, aún se está muy lejos de responder a la forma en que el sexo moldea las experiencias de las mujeres como solicitantes de asilo.

ABSTRACT: The purpose of this Final Degree Project is to study the problem of sexual violence against refugee women and girls and asylum seekers, a reality that continues to exist despite the efforts made by many States and by the UNHCR. To this end, it will be analyzed the use of this violence in conflict situations, along the routes and in the destination countries; an examination that is complex owing to the lack of reliable data on its extent and magnitude due to the chaotic circumstances and the reluctance of women themselves to report it, either for fear of further reprisals or for the stigma attached to it. Using the feminist perspective as a methodological tool for legal analysis, the urgent measures to combat and prevent this type of violence will also be assessed, given that, despite the progress made, it is still a long way from responding to the way in which sex shapes women's experiences as asylum seekers
