Gestación por sustitución: aspectos mercantiles y de consumo

Abstract

RESUMEN: En el siguiente trabajo voy a tratar los aspectos mercantiles y de consumo que hay detrás de la gestación por sustitución. Como sabemos, esta novedosa técnica ha generado polémica en los diferentes sectores de la sociedad, así como en el panorama político de España. Se han generado también numerosos problemas con la inscripción de los menores en el Registro Civil, familias se ven atrapadas en los países a los que han acudido para llevar a cabo este proceso. Esto deriva directamente de la consideración de estos contratos en nuestro Ordenamiento Jurídico como nulos de pleno derecho. He querido reflexionar sobre otras figuras que se encuentran detrás de la gestación por sustitución. En concreto, sobre las empresas y agencias dedicadas a esta técnica que generan un lucro con esta actividad. Y, como consecuencia de su presencia, la relación vertical entre personas que pueden ser consideradas consumidores y estas empresas, que determinan así una relación de consumo donde debe protegerse al más alto nivel a las partes más vulnerables: familia de intención y mujer gestante.

ABSTRACT: In the following work I will deal with the commercial and consumer aspects behind surrogacy. As we know, this new technique has generated controversy in different sectors of society, as well as in the political panorama of Spain. It has also generated many problems with the registration of minors in the Civil Registry, families are trapped in the countries where they have gone to carry out this process. This derives directly from the consideration of these contracts in our legal system as null and void. I’ve want to reflect on other figures that are behind the surrogacy. Specifically, on the companies and agencies dedicated to this technique that generate a profit with this activity. And, as a consequence of their presence, the vertical relationship between people who can be considered as consumers and these companies, which determine a consumer relationship where the most vulnerable parties must be protected at the highest level: the family of intent and the pregnant woman.
