RESUMEN: Los tratamientos paliativos son carácter general aceptados por la mayoría de la ciudadanía. Sin embargo, debemos preguntarnos si están dentro del ámbito de protección de los derechos fundamentales o no. En caso de estarlo cual es el tipo de legislación por la cual se deben regular, la ley ordinaria o la ley orgánica. También, clarificar si ciertamente se deben regular por ley orgánica porque las Comunidades Autónomas han legislado en la materia, cual es la fundamentación jurídica en la que se han amparado. Además, estudiar la proposición de ley del grupo parlamentario de Ciudadanos que fue registrada en el Congreso de los Diputados en la XII legislatura. Es la única propuesta registrada hasta le fecha, pero se debe analizar para saber si es acorde con los designios de la constitución española o no.
ABSTRACT: Palliative treatments are accepted by most of the citizenship. However, we wonder whether they are within the scope of protection of fundamental rights or not. And, if they are, what is the type of legislation by which they must be regulated, ordinary law or organic law. In addition, we are going to clarify if they should certainly be regulated by organic law because Autonomous communinties have already legislated about theissue. Also, we´ll study the proposed bill of the parliamentary group " Ciudadanos" that was registered in the Congress of Deputies in the XII legislature. It is the only proposal registered so far, and it has to be analyzed to confirm its accordance with the Spanish Constitution´s designs.
