La costumbre histórica como base y fuente del Derecho Español

Abstract

A lo largo de este trabajo, lo que intentaré será reflejar el papel que adquirió la costumbre como fuente del derecho, la importancia que tuvo y que ha tenido a lo largo del derecho hispano. Para ello, es indispensable tratar de analizar y comprender desde los inicios de la historia cómo era percibida la costumbre, su modo y uso, de cómo la entendieron los pobladores de aquellas épocas. Analizando así las primeras muestras que podemos entender como costumbre, cómo se plasmaron estas desde un inicio por escrito, hablando así para ello, desde lo que conocemos como “cartas de población”, pasando a ver cómo surgieron los “fueros” y como acabó siendo recogido como un derecho municipal. Es necesario para este análisis, ver también las diferentes etapas en las que la costumbre tuvo un papel relevante y cómo, poco a poco, fue perdiendo su funcionalidad. Es así como veremos en este trabajo cómo se reflejaba la costumbre desde la alta edad media hasta la edad moderna. Permitiéndonos con este trabajo conocer de qué manera se trató de mantener su perseverancia ante una época en la que casi supuso su olvido, y para ello conoceremos las formas en que dicha situación se trató de evitar, surgiendo así para ello figuras como las “ordenanzas” y las “instituciones jurídicas”. Analizaremos a lo largo de este trabajo su papel, su inicio y su desarrollo. Pasando a analizar, por último, cómo la costumbre aparece reflejada en materias del derecho civil, en materias como “familia, sucesiones y contratos”. A su vez, nos encontramos reflejos en la jurisprudencia, que nos permitirá también conocer más sobre esta figura y la importancia que se le dio por medio de esta práctica. Por lo que, sin más preámbulos, comenzaremos, analizando el valor que tiene la costumbre en el código civil.

Abstract: Throughout this work, what I will try to do is reflect the role that the custom acquired as the source of law, the importance it had and has had throughout Hispanic law. To do this, it is essential to try to analyze and understand from the beginning of history how the custom was perceived, its way and use, how the inhabitants of those times understood it. Analyzing, the first samples that we can understand as a custom, how these were embodied from the beginning in writing, speaking for it, from what we know as "population letters", going on to see how the "fueros" emerged and as ended up being collected as a municipal right. It is necessary for this analysis, to see also the different stages in which custom played a relevant role and how, little by little, its functionality was lost. This is how we will see in this work how the custom was reflected from the high middle ages to the modern age. Allowing us to know with this work the ways in which it was a matter of maintaining its perseverance in the face of a time when it almost involved its oblivion, and for this we will know the ways in which this situation was tried to avoid, thus emerging figures such as "ordinances" and "legal institutions". We will analyze throughout this work its role, its beginning and its development. Going on to discuss, finally, how the custom is reflected in matters of civil law, in matters such as "family, successions and contracts". In turn, we are reflected in the case-law, which will also allow us to know more about this figure and the importance that was given to it through this practice. So, without further ado, we will begin by analyzing the value that the custom has in the civil code.
