RESUMEN: Mediante el presente trabajo se pretende tomar conciencia del cambio de paradigma que suponen las nuevas tecnologías en el ámbito laboral. En concreto, los efectos que produce la geolocalización en la prestación laboral, las controversias que surgen de su utilización, y su relación con derechos fundamentales, como el derecho a la intimidad y el derecho a la protección de datos. Se abordará desde distintos puntos de vista; una primera parte, dedicada a las tecnologías de localización; una segunda parte, que estudia la geolocalización desde la perspectiva de los derechos fundamentales y la prestación laboral; una tercera parte, que analizará el papel de la negociación colectiva; y una cuarta parte, que estudiará como la obtención de datos recopilados a través de la geolocalización se pueden hacer valer ante los tribunales.
ABSTRACT: Through this work, it is intended to become aware of the paradigm shift that new technologies imply in the workplace. Specifically, the effects that geolocation produces on the work done, the controversies that arise from its use and its relationship with fundamental rights such as the right of privacy and the right of data protection. It will be approached from different points of view; the first part dedicated to location technologies; the second part, which studies geolocation from the perspective of fundamental rights and the work done; the third part, which will analyze the role of collective bargaining; and a quarter, that will study how obtaining data compiled through geolocation can be enforced in court.
