La diligencia de entrada y registro durante el proceso penal

Abstract

RESUMEN: El presente trabajo se centra en el estudio de los distintos aspectos que recoge la diligencia de entrada y registro en un lugar cerrado. Para ello, comenzaré hablando de su concepto mediante la interpretación dada por la jurisprudencia del Tribunal Constitucional y Tribunal Supremo. Profundizaré en los presupuestos marcados por la Constitución que hacen lícita la práctica de la diligencia, así como las consecuencias derivadas por la violación del derecho fundamental o de las leyes procesales.

ABSTRACT: The present work is focused on the study of the different aspects that the diligence of the entry and registration in closed place collects. In order to accomplish it, I will begin talking about its concepts through the interpretation given by the jurisprudence of the Constitutional Court and the Supreme Court. I will dive into the budgets established by the Constitution that assemble the practice of diligence lawful, as well as the consequences obtained from the violation of fundamental rights or procedural laws.
