El régimen jurídico de las intervenciones telefónicas

Abstract

RESUMEN: El teléfono móvil es un aparato electrónico indispensable en nuestra sociedad. En él se encuentran nuestros datos personales y nuestra intimidad. A la hora de descubrir o prevenir delitos, la policía judicial realiza unas diligencias, denominadas intervenciones telefónicas y telemáticas. Las telefónicas son la grabación de las llamadas, mientras que las telemáticas tienen que ver con la lectura de los SMS y las redes sociales. Estas grabaciones están amparadas bajo una resolución judicial, y en la que posteriormente los investigados pueden recurrir esta intromisión de sus llamadas, una vez finalizada la investigación. En el presente trabajo analizaremos el procedimiento de las intervenciones telefónicas, a qué derecho afecta, sus requisitos, los sujetos titulares, y la nulidad

aBSTRACT: A mobile phone is an electronic device that most people consider indispensable. In which we have our most personal datas, issues and such. When it comes to discovering or preventing crimes, the judicial police carry out procedures, called telephone and telematics interventions. The telephone interventions are the recording, while the telematic interventions is the reading of SMS and social networks. These recordings are protected under a judicial resolution, and in which the investigated ones can later appeal this interference of their calls, once the investigation is completed. The work in this paper is to acknowledge and to analice how can these devices can be intervened, how they can violate our human rights, what are there requirements, there ownwers and how to void them.
