La gestación por sustitución: situación normativa actual en España

Abstract

RESUMEN: La familia es un hecho social, que continuamente va cambiando, no hay modelos únicos de familia. Y concretamente en el derecho de filiación, antes se tenía que mantener una relación sexual con la finalidad de que posteriormente se fuese padre o madre, y en el caso de no poder concebirlo se acudía a la adopción. Pero gracias a los grandes avances científicos y tecnológicos, con las técnicas de reproducción humana, se consigue separar la reproducción humana de la sexualidad. En el presente trabajo se analiza la gestación por sustitución, una técnica, que podría ser introducida en nuestro ordenamiento jurídico. Sin embargo, dicha figura causa muchos descontentos, sobre todo a nivel moral y ético, pero a pesar de ello, no deja de ser una realidad presente en todo el mundo.

ABSTRACT: The family is a social fact, which is constantly changing, there are no unique family models. And specifically, in the right of filiation, before had to maintain a sexual relationship with the purpose of later becoming a father or mother, and in the case of not being able to conceive it went to adoption. But thanks to the great scientific and technological advances, with the techniques of human reproduction, it is possible to separate human reproduction from sexuality. In the present work the gestation by substitution is analyzed, a technique that could be introduced in our legal system. However, this figure causes many discontents, especially at a moral and ethical level, but despite this, it is still a reality present throughout the world.
